Riparian Rights and Community Property
During the Spring of 2007, Maryland's Court of Special Appeals handed down two decisions which arose in separate waterfront neighborhoods along the Severn River. Those two neighborhoods shared many issues with waterfront and water access communities throughout the state. First, there were historical understandings concerning who owned what, with respect to riparian rights, that could not entirely be traced to the deeds. Second, there had been changes in ownership in recent times and efforts to clarify the questions of individual versus community rights. Those two neighborhoods were Pines on the Severn (in which this firm represented a number of landowners) and Olde Severna Park. The Daily Record contacted J.
